CMA Investigates 8 Companies for Online Pricing Strategies

Investigations have commenced into the practices of eight companies concerning their online pricing strategies, with an additional 100 businesses expected to receive warnings soon.

The companies under scrutiny include StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical. The Competition and Markets Authority (CMA) is focusing on how fees are displayed online, potential misleading time-limited offers, and the automatic opt-in for optional charges affecting customers.

Specifically, StubHub and Viagogo are being investigated for additional charges related to ticket purchases. AA Driving School and BSM Driving School are under review for their fee presentation on websites, including transparency at the start of the purchasing process. Gold’s Gym is facing an inquiry regarding the one-off joining fee for its annual membership, especially the timing of its introduction during the sign-up process.

Wayfair is being examined in relation to time-limited sales, Marks Electrical for default opt-ins, and Appliances Direct for their use of time-limited sales and default opt-ins. The CMA emphasized that there are suspicions of potential breaches of consumer law by these companies, although no final decisions have been reached yet.

These cases mark the initial investigations utilizing the CMA’s new consumer protection powers. The CMA is also contacting 100 other businesses to address concerns regarding additional fees and sales tactics. CEO Sarah Cardell stressed the importance of ensuring consumers can shop online confidently, with transparent pricing and genuine sales.

She highlighted the significance of fair deals for consumers across various sectors, emphasizing the watchdog’s commitment to preventing misleading practices. The CMA aims to enforce consumer law compliance and swiftly address any serious breaches to protect consumer interests and promote fair business practices.

Spokespersons from AA Driving School and Viagogo expressed willingness to cooperate with the investigations. The Mirror reached out to Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct for comments. BSM Driving School is a part of the AA, while Viagogo and Stubhub share the same parent company.
